As repeal of a statute by replacement and introduction of new statute substituting the old one, creates hurdles and dilemma as to its implementation and the sanctity of provisions, in absence of any explanation to that effect and more particularly where the Code of Criminal Procedure, 1973 came to be repealed by introducing Bhartiya Nagrik Suraksha Sanhita, 2023, responsibility came to be casted on the Parliamentarians and the Law Framing Committee to explain the provisions incorporated in the new enactment; keeping in mind the provisions laid under The Constitution of India, 1950, so that none of the provisions in the new enactment should be ambiguous and take away the right of a citizen who is accused of an offence and is protected by the Constitution of India, 1950.
