As repeal of a statute by replacement and introduction of new statute substituting the old one, creates hurdles and dilemma as to its implementation and the sanctity of provisions, in absence of any explanation to that effect and more particularly where the Code of Criminal Procedure, 1973 came to be repealed by introducing Bhartiya Nagrik Suraksha Sanhita, 2023, responsibility came to be casted on the Parliamentarians and the Law Framing Committee to explain the provisions incorporated in the new enactment; keeping in mind the provisions laid under The Constitution of India, 1950, so that none of the provisions in the new enactment should be ambiguous and take away the right of a citizen who is accused of an offence and is protected by the Constitution of India, 1950.

Thus, keeping in mind the fact that the Bhartiya Nagarik Suraksha Sanhita, 2023, being a new statute, it becomes incumbent to explain the Constitutional Safeguards, which have been elaborated by the Hon’ble Supreme Court of India, in catena of judgments, which elaborate the guidelines and which being in consonance to the Fundamental Rights laid under The Constitution of India, 1950, the book is written explaining the crux and the intent of the legislature while enacting the Bhartiya Nagarik Suraksha Sanhita, 2023, and to safeguard the rights of accused and every citizen; as the new law has vested the Investigating agency with extensive rights of investigation, how and in what manner rights of an individual can be safeguarded, is explained inter-alia the Bhartiya Nagarik Suraksha Sanhita, 2023 and Code of Criminal Procedure, 1973.
